For custom cattle feedlot operators, Iowa Code Chapter 579A establishes an agricultural lien on the cattle and the identifiable cash proceeds from their sale. To protect this priority status, we assist farmers by filing a financing statement with the office of the Iowa Secretary of State within 20 days after the cattle arrive at the feedlot.
For growers and other livestock producers operating under a commodity production contract, Iowa Code Chapter 579B provides a commodity production contract lien. This lien applies to livestock, raw milk, or crops, as well as the cash proceeds from their sale. Unless a contract provides for continuous arrival, a producer must file a financing statement within 45 days after the livestock arrives or within 45 days after a crop is first planted. If the contract provides for continuous arrival, the timeline changes to one hundred eighty days after arrival. We understand these exact timelines and file the necessary documentation to ensure our clients maintain leverage during commercial disputes.
Boundary lines and fence maintenance are frequent sources of friction between adjacent landowners in the agricultural community. There is no automatic duty to build a partition fence, but an adjoining neighbor can compel a contribution through a written request. If neighbors cannot reach an agreement regarding the erection or repair of a lawful fence, local township trustees act as fence viewers to legally allocate responsibility.
A livestock owner is liable for property damage caused by straying animals if the escape resulted from the owner’s negligence. But a livestock owner is not liable for damages if the animals trespassed through a section of a partition fence that the complaining neighbor failed to maintain properly. When a habitual trespass occurs, defined as three or more separate instances within 12 months, we help landowners issue formal written requests to compel the responsible party to build or maintain a protective fence.
Managing a modern agribusiness requires proactive legal strategies covering a variety of corporate, real estate, and financial matters. Our practice areas include assisting clients with agricultural land acquisitions, commercial financing, custom farm leases, and environmental compliance.
Securing the future of a family farm also demands careful estate planning to mitigate heavy taxation and prevent internal family disputes upon the death of an operator.
We help clients navigate the complexities of farm transitions by utilizing:
Family Limited Partnerships (FLPs) and limited liability companies to preserve operating capital
Custom agricultural leases that protect active operators while providing equitable returns to non-farming heirs
Buy-sell agreements that outline clear terms for buying out farm shares
Strategic tax planning to minimize federal and state estate tax liabilities
Do not leave the future of your agribusiness or family land to chance.
